1. Introduction

SoundBooth Bot is a chat-based soundboard application operated by Richard Thornton trading as SoundBooth Bot, ABN 41 457 527 181, registered in Australia. By accessing or using the service, you acknowledge and agree to be bound by these Terms and Conditions and our Privacy Policy.

2. Service Description

The platform provides chat-driven soundboard functionality that integrates with Twitch, YouTube, and Discord streaming services. Features include:

• Browser-based sound overlays
• Global and seasonal sound packs
• Chat command triggers for sound playback
• Custom sound uploads (Starter and Pro tiers)
• Sound packs for organizing custom sounds
• Multi-file sounds with random or sequential playback
• Stream analytics and heatmaps (Pro tier)
• Audio normalization (Pro tier)
• Gift subscription system
• Discord integration for notifications and authentication

3. Account Registration

Users must authenticate via Twitch, YouTube, or Discord. Account holders must meet the minimum age requirements of their chosen platform and maintain the security of their credentials. Any unauthorized account activity must be reported to us immediately.

4. Acceptable Use

Prohibited activities include:

• Uploading copyrighted audio without permission
• Uploading explicit, hateful, or offensive content
• Uploading content that promotes illegal activities
• Attempting unauthorized access to our systems
• Disrupting or interfering with the service
• Reselling or redistributing the service without authorization

Violations will result in content removal and may lead to account suspension or permanent ban.

5. User Content

You retain ownership of your uploaded custom sounds. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and transmit that content solely for the purpose of providing the service.

Upload Specifications

• Formats: MP3 or WAV
• Maximum file size: 2MB per file
• Maximum duration: 30 seconds per file

Tier Limits

Inactive Subscriptions

When your subscription becomes inactive (canceled or expired), your custom sounds and packs become read-only. You cannot create, edit, delete, or reorganize sounds or packs until you resubscribe. Your data is preserved and will become fully accessible again upon reactivation. Custom sounds are not playable by viewers while your subscription is inactive.

6. Third-Party Services

Our service integrates with the following third-party platforms. Your use of these integrations is also governed by their respective terms and policies:

7. Subscription and Payment

SoundBooth Bot offers Free, Starter, and Pro tiers with the following pricing (in AUD):

Starter Tier

• Monthly: $5/month
• 6-Month: $30 (includes 1 bonus month, equivalent to 7 months)
• Annual: $60 (includes 3 bonus months, equivalent to 15 months)

Pro Tier

• Monthly: $15/month
• 6-Month: $90 (includes 1 bonus month, equivalent to 7 months)
• Annual: $180 (includes 3 bonus months, equivalent to 15 months)

Payment Processing

All payments are processed via Stripe or PayPal. We use a one-time payment model (not managed recurring subscriptions). When you purchase a subscription:

• You make a one-time payment for the chosen billing cycle
• Your payment method is securely stored for future auto-renewal (if enabled)
• We store only minimal payment information (Stripe: payment method ID, card brand, last 4 digits; PayPal: billing agreement ID, payer email)

Auto-Renewal

Auto-renewal is enabled by default when you subscribe. When auto-renewal is enabled:

• Your subscription will automatically renew at the end of each billing period
• You will be charged using your stored payment method
• You will receive an email confirmation after each renewal
• You can disable auto-renewal at any time from your account settings

Important: To disable auto-renewal, you must have a stored payment method. The toggle is unavailable if you don't have payment information on file.

Subscription Changes

You can cancel your subscription or disable auto-renewal at any time. Changes take effect at the end of your current billing period. No prorated refunds are provided for partial billing periods.

Failed Payments

If auto-renewal fails, we will attempt to contact you via email. If payment cannot be processed within 7 days, your subscription will expire and auto-renewal will be disabled.

8. Account Cancellation

There is an important distinction between disabling auto-renewal and full account cancellation:

Disabling Auto-Renewal

• Your subscription remains active until the end of your current billing period
• After expiration, you retain access to Free tier features
• Your custom sounds and packs are preserved but become read-only
• You can resubscribe at any time to regain full access

Full Account Deletion

• Accessible via account settings
• Your account data is archived for 7 years for legal and analytical purposes
• You may request earlier deletion by contacting us
• Reactivation within the archival period may restore your previous data

9. Service Availability

We do not guarantee continuous, uninterrupted access to the service. We reserve the right to modify, suspend, or discontinue any aspect of the service with or without notice.

10. Intellectual Property

All service content, features, and functionality (including but not limited to software, text, graphics, logos, and design) are the property of SoundBooth Bot and are protected under Australian and international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our service without our prior written consent.

Branding

When referring to our service, please use proper branding: "SoundBooth Bot" with uppercase "S" and "B", with "Bot" as a separate word.

11. Limitation of Liability

To the fullest extent permitted by Australian law, SoundBooth Bot excludes all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the service.

Consumer Guarantees: Nothing in these terms excludes, restricts, or modifies any guarantee, warranty, term, condition, or remedy implied or imposed by the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted, or modified.

12. Indemnification

You agree to indemnify and hold harmless SoundBooth Bot, its operators, and affiliates from any claims, damages, liabilities, and expenses (including legal fees) arising from:

• Your use of the service
• Your violation of these Terms
• Your infringement of any third-party rights

13. Force Majeure

Neither party shall be liable for any failure or delay in performance caused by events beyond their reasonable control, including but not limited to natural disasters, government actions, telecommunications failures, or internet disruptions.

14. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes arising from these Terms or your use of the service shall fall under the exclusive jurisdiction of the courts of Victoria, Australia.

15. Changes to Terms

We may update these Terms from time to time. When we do, we will post the updated Terms on our website and update the revision date. Continued use of the service after changes constitutes acceptance of the modified Terms.

16. Gift Subscriptions

Our gift subscription system allows viewers to purchase subscription time for streamers:

Gift Purchases

• Gifts can only be purchased when the streamer has 7 days or less remaining on their subscription AND auto-renewal is disabled
• Gift purchases are processed via Stripe or PayPal
• Gifts can include an optional custom sound upload

Approval Process

• Streamers must approve or reject gift subscriptions
• If approved, the gift time is added to the streamer's subscription
• If a custom sound was included, the streamer can accept, modify, or reject it
• Approved custom sounds count toward the streamer's sound limit

Refunds

• Gift purchases are non-refundable once approved by the streamer
• If a gift is rejected by the streamer, the purchaser will be refunded within 7-10 business days
• Abandoned gift checkouts (not completed within 9 minutes) are automatically deleted

17. Tier Downgrades

When downgrading from Pro to Starter or Starter to Free:

Scheduled Downgrades

• Downgrades are scheduled to occur at the end of your current billing period
• You can cancel a scheduled downgrade at any time before it takes effect
• You will receive email notification 7 days before the downgrade

Over-Limit Content

• If you have more sounds or packs than your new tier allows, the excess content is automatically disabled
• Over-limit content is marked with an "Over limit" badge in your dashboard
• You cannot edit or use over-limit sounds until you re-enable them or upgrade
• Your data is preserved and not deleted

Re-Enabling Content

• You can re-enable over-limit sounds up to your new tier's limit
• Access the "Re-enable sounds" feature from your sounds page
• Select which sounds to re-enable within your available slots
• Alternatively, upgrade your subscription to regain access to all content
